Can a homeowner pull their own permit in Milpitas?
The Milpitas FAQ says a property owner may obtain permits for work performed. It also describes an authorized contractor acting for the owner, within the work permitted by that contractor’s credential. The city places this guidance under its question about obtaining a building permit after plan review.
The city’s wording for owners is: “A property owner may obtain permits for any work performed.”
Submitting drawings for review does not itself authorize the start of construction. The city FAQ answers that separate question by requiring issuance of the building permit before work begins. Keep that distinction when following the application through review and issuance.
No, the Building Permit must be issued prior to the commencement of any work.

What work does not need a permit in Milpitas?
The city publishes separate building exemption lists for California Building Code projects and California Residential Code projects. The residential list below applies to one- and two-family dwellings. It includes conditions for accessory structures, fences, retaining walls, tanks, pools, awnings and decks; the conditions remain part of each item.
For buildings regulated by the California Residential Code for One- and Two- Family Dwellings, a Building Permit is not required for the following: Other than storm shelters, one-story detached accessory structures, provided that the floor area does not exceed 120 square feet. Fences not over 7 feet high. Retaining walls that are not over 4 feet in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter or width does not exceed 2 to 1. Sidewalks and driveways. Painting, papering, tiling, carpeting, cabinets, counter tops, and similar finish work. Prefabricated swimming pools that are less than 24 inches deep. Swings and other playground equipment. Window awnings supported by an exterior wall that do not project more than 54 inches from the exterior wall and do not require additional support. Decks not exceeding 200 square feet in area, that are not more than 30 inches above grade at any point, are not attached to a dwelling and do not serve the exit door required by Section R311.4. (California Residential Code, R105.2 – Work exempt from permit)

The other published list is explicitly labeled for buildings regulated by the California Building Code. It also names finish work, temporary stage sets, shade-cloth structures and movable fixtures. Use the list tied to the code regulating the building; the FAQ prints the code citation at the end of each list.

The search form itself accepts an address or permit number, so the result list is the starting point for those details.
8. Once you click on the permit you will be able to view information pertaining to that permit including the scope of work, permit status, fees, site information, plan check and inspection results.

Before you apply in Milpitas: checklist
Describe the scope of work and its square footage when preparing project information for the Permit Center. The city lists those items in its guidance for a permit-fee estimate. After the permit application package is submitted, the FAQ describes routing the drawings to city departments for review.
For the city’s application sequence, read the Building Permit Process (PDF). For online permits, the FAQ names water-heater and furnace replacement, bathroom and kitchen remodels, and re-roofs. The city’s Building Online Permitting System page supplies the corresponding online instructions.

How much is a permit and how long does it take in Milpitas?
For the published government schedule, open Fee Schedules. The city labels the linked building schedule effective November 2, 2026. The FAQ says plan-review turnaround depends on project scope and use; it refers applicants to a separate turnaround handout.
The city’s January 1, 2026 inspection handout describes typical sequences for single-family wood-framed residential construction. It separates raised-floor foundations from slab-on-grade foundations, then identifies later roof, rough-trade, insulation, drywall and final inspections. The handout says projects differ and asks applicants to confirm the next required inspection with the assigned inspector.
The plan review turnaround time is based on the scope of work and type of use, such as Commercial or Residential, indicated in the submittal. Please refer to the Plan Review Turnaround Time (PDF) handout for more information.
