Why must some Texas home improvement contracts be signed at a title company or lawyer's office?

The Texas Constitution sets it as a condition for repair or renovation work on a homestead: Article XVI, section 50(a)(5)(D) says the contract is executed by the owner and the owner's spouse only at the office of a third-party lender making an extension of credit for the work and material, an attorney at law, or a title company.

Key facts

Where does the Texas Constitution say the contract is signed?

Item (D) of Article XVI, section 50(a)(5) names three places: the office of a third-party lender making an extension of credit for the work and material, an attorney at law, or a title company. The item, and the sentence it belongs to, are quoted below in their own words.

Article XVI, section 50(a) of the Texas Constitution, read 22 October 2026, opens: "The homestead of a family, or of a single adult person, shall be, and is hereby protected from forced sale, for the payment of all debts except for:"

The fifth item on that list reads: "(5) work and material used in constructing new improvements thereon, if contracted for in writing, or work and material used to repair or renovate existing improvements thereon if:"

The last of its four conditions reads: "(D) the contract for the work and material is executed by the owner and the owner's spouse only at the office of a third-party lender making an extension of credit for the work and material, an attorney at law, or a title company;"

In our reading, the office rule is tied to the repair-and-renovation exception quoted above: it is one of the conditions the debt for repair or renovation work has to meet before the homestead stops being protected from a forced sale for it. What happens to a contract signed somewhere else is a question for a Texas attorney.

Does the rule cover new construction or only repairs?

Section 50(a)(5) treats the two kinds of work differently. Its words: "(5) work and material used in constructing new improvements thereon, if contracted for in writing, or work and material used to repair or renovate existing improvements thereon if:" The four conditions, including the office rule, follow its words about repairing or renovating existing improvements.

In our reading, a remodel of a kitchen, a new roof on the house you live in, or other work on what is already there falls on the repair-or-renovate side. A project that mixes new and existing work is worth asking a Texas attorney or the title company about before anyone signs.

What Texas contract conditions and emergency exceptions does the Constitution describe?

The same section lists three more conditions before item (D): spousal consent, a waiting period after a written credit application, and a right to rescind. Each is quoted below in its own words.

Section 50(a)(5)(A), read 22 October 2026: "(A) the work and material are contracted for in writing, with the consent of both spouses, in the case of a family homestead, given in the same manner as is required in making a sale and conveyance of the homestead;"

Section 50(a)(5)(B), read the same day: "(B) the contract for the work and material is not executed by the owner or the owner's spouse before the fifth day after the owner makes written application for any extension of credit for the work and material, unless the work and material are necessary to complete immediate repairs to conditions on the homestead property that materially affect the health or safety of the owner or person residing in the homestead and the owner of the homestead acknowledges such in writing;"

Section 50(a)(5)(C): "(C) the contract for the work and material expressly provides that the owner may rescind the contract without penalty or charge within three days after the execution of the contract by all parties, unless the work and material are necessary to complete immediate repairs to conditions on the homestead property that materially affect the health or safety of the owner or person residing in the homestead and the owner of the homestead acknowledges such in writing; and"

Source: Texas Constitution, Article XVI, General Provisions, section 50 (Texas Legislative Council statutes file), read 22 October 2026.

Items (B) and (C) each carry an exception for immediate repairs to conditions that materially affect the health or safety of the owner or person residing in the homestead, when the owner acknowledges such in writing. Item (D), the office rule quoted above, contains no such clause.

In our reading, an urgent repair can shorten the waiting period and the rescission window only through the owner's written acknowledgment, and it does not move the signing out of the lender's, attorney's or title company's office.

What does the Texas Property Code add for a homestead lien?

Texas Property Code section 53.254 says that to fix a lien on a homestead, the person who is to furnish material or perform labor and the owner must execute a written contract setting forth the terms of the agreement. Its timing, spouse and filing rules are quoted below.

Tex. Prop. Code section 53.254, read 22 October 2026: "(a) To fix a lien on a homestead, the person who is to furnish material or perform labor and the owner must execute a written contract setting forth the terms of the agreement." "(b) The contract must be executed before the material is furnished or the labor is performed." "(c) If the owner is married, the contract must be signed by both spouses."

How do you get a Texas homestead repair contract signed properly?

Treat the signing as an appointment, not a kitchen-table moment, and line up the people and the papers before the contractor brings the final copy. This is practical reasoning, not legal advice and not a finding from any agency.

  1. Ask the contractor, before you agree on a start date, whether the contract will give a lien on your homestead and whether it is being financed by a lender.
  2. Book the signing at the lender's office, an attorney's office or a title company, the places item (D) names, and plan for both spouses to be there if you are married.
  3. If there is a written credit application, note its date and count the days before the signing date; item (B) is quoted above.
  4. Read the contract for the rescission wording that item (C) describes before you sign, and keep a signed copy.
  5. Ask who will file the contract with the county clerk and when you will get a copy of the filed record, as the filing rule quoted above describes.
  6. If the job mixes new building with work on what is already there, or anyone suggests signing at your home, ask a Texas attorney first.
