Who is responsible for repairs in a Utah HOA?
Utah Code chapter 57-8a answers in 57-8a-224(2), read 2026-10-29 on le.utah.gov: except as otherwise provided in the declaration or Part 4, Insurance, and outside the period of administrative control (57-8a-224(5)), “an association is responsible for the maintenance, repair, and replacement of common areas; and” (Utah Code § 57-8a-224) (57-8a-224(2)(a)), and “a lot owner is responsible for the maintenance, repair, and replacement of the lot owner's lot.” (Utah Code § 57-8a-224) (57-8a-224(2)(b)).
When the board of an association under chapter 57-8a needs to reach a lot for common-area work, reasonable notice under 57-8a-224(1)(b), outside the period of administrative control (57-8a-224(5)), is written notice hand delivered to the lot at least 24 hours before the proposed entry, or, in the case of an emergency repair, notice that is reasonable under the circumstances.
When a common-area repair falls to the association, a Utah HOA board can post that job on InstaBids and compare written bids on the same scope.
How can an owner see HOA records in Utah?
For an association under Utah Code chapter 57-8a, 57-8a-227(4)(a), read 2026-10-29 on le.utah.gov, sets the window for a lot owner's written request to inspect or copy documents: “An association shall comply with a request described in Subsection (3) within 10 business days after the day on which the association receives the request.” (Utah Code § 57-8a-227)
Under chapter 57-8a the 10 business days run from the day on which the association receives the written request (57-8a-227(4)(a)).
If an owner's records request turns up a deferred repair in the common areas, the board can post that job on InstaBids to get written bids.
What records does a Utah HOA have to keep?
Utah Code chapter 57-8a lists them in 57-8a-227(1)(a), read 2026-10-29 on le.utah.gov, subject to 57-8a-227(1)(b): “Subject to Subsection (1)(b) and regardless of whether the association is incorporated under Title 16, Chapter 6a, Utah Revised Nonprofit Corporation Act , an association shall keep and make available to lot owners:” (Utah Code § 57-8a-227) the records named in the Utah Revised Nonprofit Corporation Act and a copy of the association's governing documents, most recent approved minutes, most recent annual budget and financial statement, most recent reserve analysis, certificate of insurance for each insurance policy the association holds, board meeting minutes from the previous three calendar years, and profit and loss statement and balance sheet for the previous three fiscal years.
Under chapter 57-8a, 57-8a-227(1)(b) lets an association redact a Social Security number, a bank account number or any communication subject to attorney-client privilege from any document it produces for inspection or copying.
When board minutes approve a common-area project, such as repainting or fence repair, the manager can post it on InstaBids and compare written bids.
How much notice does a Utah HOA board give before a meeting?
For an association under Utah Code chapter 57-8a, 57-8a-226(2)(a), read 2026-10-29 on le.utah.gov, outside the period of administrative control (57-8a-226(7)(a)), reads: “At least 48 hours before a board meeting, the association shall give written notice of the board meeting via email to each lot owner who requests notice of a board meeting, unless:” (Utah Code § 57-8a-226) the meeting is in a board meeting schedule previously provided to the lot owner, or it is to address an emergency and each board member receives notice less than 48 hours before it.
Under chapter 57-8a, outside the period of administrative control (57-8a-226(7)(a)), except as provided in 57-8a-226(3)(b): “Except as provided in Subsection (3)(b) , a board meeting shall be open to each lot owner or the lot owner's representative if the representative is designated in writing.” (Utah Code § 57-8a-226) Under chapter 57-8a a board may close a board meeting, outside the period of administrative control (57-8a-226(7)(a)), to “discuss a matter relating to contract negotiations, including review of a bid or proposal;” (Utah Code § 57-8a-226) (57-8a-226(3)(b)(iv)).
To bring written bids for a common-area job, like a pool or clubhouse repair, to the next board meeting, a manager can post the job on InstaBids first.
Can a Utah HOA fine an owner without a hearing?
Utah Code chapter 57-8a puts a written warning first, in 57-8a-208(2)(a), read 2026-10-29 on le.utah.gov: “Before assessing a fine under Subsection (1) , the board shall give the lot owner a written warning that:” (Utah Code § 57-8a-208) describes the violation, states the rule or provision violated and states that the board may assess fines.
Under chapter 57-8a, for a continuing violation the board's written warning “if the violation is a continuing violation, states a time that is not less than 48 hours after the day on which the board gives the lot owner the written warning by which the lot owner shall cure the violation.” (Utah Code § 57-8a-208) (57-8a-208(2)(a)(iv)).
Under chapter 57-8a the hearing comes after the fine, on the request of the lot owner who is assessed a fine (57-8a-208(4)(a)): “A lot owner who is assessed a fine under Subsection (1) may request an informal hearing before the board to dispute the fine within 30 days after the day on which the lot owner receives notice that the fine is assessed.” (Utah Code § 57-8a-208)
When a violation warning names a yard, fence or exterior upkeep problem, the lot owner can post that repair on InstaBids to compare written bids.
Does Utah HOA law apply to condominiums?
Utah Code chapter 57-8a sets its own reach in 57-8a-103(2), read 2026-10-29 on le.utah.gov: “This chapter applies to an association if:” (Utah Code § 57-8a-103) the association's declaration states that this chapter applies, or, if the declaration does not state whether chapter 57-8a or Chapter 8, Condominium Ownership Act, applies to the lot, the plats within the association are not designated as condominium plats.
So an association on condominium plats whose declaration does not state that chapter 57-8a applies is outside chapter 57-8a; it falls under Chapter 8, the Condominium Ownership Act, which this page does not quote (57-8a-103(2)(b)).
Whichever Utah chapter covers the building, a condo or HOA board can post shared-building work like roofing or siding on InstaBids for written bids.
Does a Utah HOA have to register with the state?
Utah Code chapter 57-8a sets it in 57-8a-105(2)(a), read 2026-10-29 on le.utah.gov, with the Department of Commerce as the department: “No later than 90 days after the recording of a declaration of covenants, conditions, and restrictions establishing an association, the association shall register with the department in the manner established by the department.” (Utah Code § 57-8a-105)
Once the association is registered, its manager can post common-area upkeep, such as landscaping or parking-lot repair, on InstaBids for written bids.
How often does a Utah HOA board update its reserve analysis?
Under Utah Code chapter 57-8a, 57-8a-211(2), read 2026-10-29 on le.utah.gov, except as otherwise provided in the governing documents and outside the period of administrative control (57-8a-211(10)), a board shall cause a reserve analysis to be conducted no less frequently than every six years and shall review and, if necessary, update a previously conducted reserve analysis no less frequently than every three years (57-8a-211(2)(a) and (b)).
When a reserve analysis update flags a roof, paving or siding replacement, a board can post that reserve-driven project on InstaBids and compare written bids.

- Who repairs what: under chapter 57-8a, except as otherwise provided in the declaration or Part 4, Insurance, and outside the period of administrative control (57-8a-224(5)), an association is responsible for the maintenance, repair, and replacement of common areas and a lot owner is responsible for the maintenance, repair, and replacement of the lot owner's lot (57-8a-224(2)).
- Access to a lot for the work: under chapter 57-8a, outside the period of administrative control (57-8a-224(5)), reasonable notice is written notice hand delivered to the lot at least 24 hours before the proposed entry, or for an emergency repair notice that is reasonable under the circumstances (57-8a-224(1)(b)).

- Reserve components: under chapter 57-8a, except as otherwise provided in the governing documents and outside the period of administrative control (57-8a-211(10)), a board shall cause a reserve analysis to be conducted no less frequently than every six years and review and, if necessary, update a previously conducted reserve analysis no less frequently than every three years (57-8a-211(2)).
Calling contractors one by one, or one written scope?
Calling contractors one by one gets each one's own idea of the job. With one written scope, you describe it once, contractors bid in writing on that scope, and you choose who gets your number.
Property managers can post a rental job on InstaBids today.
